1. Introductory provisions
1.1 These Terms of Service ("Terms") are issued by forehead s.r.o., a company with its registered office at Jaurisova 515/4, Michle, 140 00 Praha 4, Czech Republic, Company ID (IČO) 21908117, VAT ID (DIČ) CZ21908117, registered in the Commercial Register kept by the Municipal Court in Prague, file C 407991 ("we", "us" or the "Operator"). We operate the services offered under the brand GetProofAnchor at getproofanchor.com. You can contact us at hello@getproofanchor.com or by phone on +420 722 428 407 (also WhatsApp).
1.2 The Terms govern the rights and obligations arising from contracts concluded between us and you (the "Customer") for the use of the services described in section 5. They form part of each such contract. The contract also consists of the order you placed (the selected plan, tier or licence and its price as shown before payment) and, for business customers who process personal data through the service, the Data Processing Agreement published at getproofanchor.com/dpa. Our Privacy Policy explains how we process personal data; it is information, not a contractual term.
1.3 Some provisions apply only to consumers or only to business customers; this is always stated. A consumer is a natural person who, outside the scope of their trade, business or profession, enters into a contract with us. A business customer is anyone else, in particular a company, a self-employed person acting in that capacity, a law firm or a public authority.
1.4 The Terms are available in Czech, English, German and French, and the contract can be concluded in any of these languages. If the language versions differ, the following applies: for consumers, the version in the language in which the contract was concluded prevails (for consumers in the Czech Republic the Czech version); for business customers, the English version prevails.
1.5 Provisions deviating from these Terms may be agreed in writing (for example a Custom plan contract or a public-procurement contract). Such provisions prevail over the Terms.
2. Definitions
2.1 In these Terms:
- Service: all services we provide under the GetProofAnchor brand, i.e. the Platform, Assisted Capture and the Forensic Browser.
- Platform: the web application at getproofanchor.com/app, including the browser extension, the public proof pages, the online verifier and, where included in the plan, monitors and API keys.
- Account: your user account on the Platform, created with your e-mail address.
- Workspace: the space in which proofs are created and stored; a personal workspace belongs to one user, a team workspace (Business plan) belongs to its owner and may have further members (seats).
- Proof: an evidence record created by the Service from a web page, a file or another source, consisting in particular of a screenshot, the page source, technical and network metadata, a manifest of SHA-256 hashes, a qualified electronic timestamp and an OpenTimestamps anchor.
- Evidence package: the downloadable ZIP archive of a proof together with the PDF report.
- Proof credit: a prepaid right to create one proof, purchased in a one-time pack.
- Subscription: a recurring paid plan of the Platform (Pro, Expert, Business, Monitoring 50 or Monitoring 100), billed monthly or yearly.
- Quota: the number of proofs that a subscription allows within a rolling period of 30 days.
- Assisted Capture: the done-for-you service in which our operator captures the URLs you submit and delivers the evidence.
- Forensic Browser: our desktop application for Windows for capturing whole browsing sessions, provided under an annual licence.
- Stamp: one sealing of a capture with a qualified electronic timestamp within the Forensic Browser licence.
- Qualified timestamp: a qualified electronic time stamp within the meaning of Regulation (EU) No 910/2014 (eIDAS), currently issued by SK ID Solutions AS (Estonia), a qualified trust service provider listed on the Estonian trusted list (accessible via the EU Trusted List Browser).
- Content: any data you capture, upload or submit through the Service, including content of third-party web pages.
3. Conclusion of the contract
3.1 Our presentation of the Service on the website is an invitation to make an offer, not a binding offer. Prices and parameters are shown at the time of the order.
3.2 Account. You create an Account by entering your e-mail address on the sign-in page, which refers you to these Terms and to the Privacy Policy, and by confirming the one-time sign-in link we send to that address. By continuing you accept these Terms, and a contract for the use of the free Account is concluded. The free Account does not include any proofs; it allows you to sign in, purchase plans, view and verify proofs.
3.3 Paid services. You order a pack, a subscription, Assisted Capture or a Forensic Browser licence by selecting it on our website and completing the payment form of our payment provider Stripe ("Stripe Checkout"). Before you pay, the checkout shows a summary of the order, the price including VAT and the payment method, and you can correct any input errors by going back or changing the entries. In the checkout you confirm that you accept these Terms and, if you are a consumer, you give the request and acknowledgement under clause 18.2. The contract is concluded when the payment has been successfully completed and confirmed. We confirm the contract by e-mail without undue delay, with a link to the version of these Terms that applies; Stripe sends you the receipt or invoice.
3.4 Assisted Capture is ordered through the form on getproofanchor.com/assisted-capture without an Account; for this, you enter your e-mail address, the URLs and optional notes and then pay in Stripe Checkout.
3.5 Custom plans and contracts with public authorities are concluded on the basis of an individual offer or contract.
3.6 We store the concluded contract (the order data, the version of these Terms valid at the time and the record of your acceptance with date and time) in electronic form. On request we will send you the order data and the relevant version of the Terms. The contract is not accessible to third parties.
3.7 You must be at least 18 years old and have full legal capacity to conclude a contract. If you act on behalf of a legal entity, you confirm that you are authorised to bind it.
3.8 The costs of the means of distance communication (internet connection) are borne by you; we do not charge anything extra for them.
4. Account and security
4.1 You must provide a working e-mail address and true information, and keep it up to date. Each Account is personal. In a team workspace each member uses their own Account; sharing sign-in details is not permitted.
4.2 You must keep your sign-in links, password, API keys and licence keys confidential and inform us without undue delay if you suspect misuse. Actions taken through your Account or keys are attributed to you unless you prove misuse that you could not prevent. For consumers this applies only if they intentionally or negligently breached the obligation in the first sentence.
4.3 The owner of a team workspace decides who becomes a member and with which role, and is responsible for the members' use of the workspace. Proofs created in a team workspace belong to the workspace; they remain there when a member leaves or deletes their Account.
4.4 You can delete your Account at any time in the dashboard. Section 17 describes what happens to your data and proofs.
5. The Platform: proofs, subscriptions and the extension
5.1 The Platform lets you create proofs (a) on our servers, which load the URL you submit in an isolated Chromium browser and record the page, and (b) in your own Chrome browser through our browser extension, which captures the page as you see it on your device and sends the capture to us, where it is sealed on receipt. The current scope of a proof (for example screenshot, HTML, MHTML, HAR network log with cookies and authorisation headers redacted, optional video, TLS certificate chain, DNS records and RDAP/WHOIS data) is described in our documentation and in the PDF report of each proof. The browser extension requires Google Chrome version 116 or later on a desktop computer (Windows, macOS or Linux).
5.2 Every proof created under a paid plan or credit is sealed with a qualified timestamp and anchored via OpenTimestamps in the Bitcoin blockchain. If the qualified trust service provider is temporarily unavailable, the proof is created and the timestamp is obtained additionally as soon as possible; the proof shows this state. A Bitcoin confirmation usually takes several hours.
5.3 Proofs are immutable: once created, their evidence data cannot be changed or deleted by you or by us. You can revoke a proof (it remains in the record, marked as revoked) and you decide whether a proof is published on a public proof page accessible via its link. Proofs created through the browser extension are private by default. You can download the evidence package and verify it offline with the open-source tool gpa-verify, without depending on us.
5.4 The scope of each plan (number of proofs, seats, monitors, other features) is stated in the price list at getproofanchor.com/pricing at the time of the order. In summary: the free Account includes no proofs; the pack contains 3 proof credits for a one-time payment; the Pro, Expert and Business subscriptions include a quota of 10, 100 and 400 proofs per rolling 30 days; the Monitoring 50 and Monitoring 100 subscriptions include 1 800 and 3 500 proofs per rolling 30 days; Business, Monitoring 50 and Monitoring 100 include 10 seats (further seats can be purchased) and 10, 50 and 100 monitors respectively, and every monitor check uses one proof from the quota; a Custom plan is agreed individually. We do not offer a free trial.
5.5 Monitors carry out scheduled captures; each scheduled capture uses the quota. API keys, where included in the plan, may only be used for the integrations we document and are subject to rate limits.
5.6 We may refuse or stop a capture that would breach section 11, the law or the security of our systems (for example URLs pointing to internal networks), or that cannot technically be carried out; a refused or failed capture does not use a credit or quota.
6. Prices, VAT and payment
6.1 Prices are stated in euros. For consumers we always state the final price including VAT; prices excluding VAT are for business customers. VAT is calculated by Stripe Tax in accordance with the applicable rules, and the final price is shown before you pay:
- consumers in the EU and all customers in the Czech Republic pay Czech VAT at the rate of 21 %, unless the law requires otherwise (in particular once the EUR 10,000 threshold for cross-border supplies to EU consumers is exceeded);
- business customers established in another EU Member State who enter a valid VAT ID are invoiced without VAT under the reverse-charge mechanism;
- customers outside the EU are invoiced without VAT, unless the law requires otherwise.
6.2 Payment is made in advance through Stripe, by card or another method offered in Stripe Checkout. Subscriptions and licences are charged automatically at the start of each billing period to the stored payment method. We do not store your card data.
6.3 We issue tax documents (invoices or receipts) electronically through Stripe; you agree to receive them in electronic form. Invoices for subscriptions and licences can be downloaded in the Stripe customer portal.
6.4 If a recurring payment fails, Stripe will retry it and notify you. If the payment is not made within the retry period, we may limit the paid features or end the subscription; the free Account and your existing proofs remain.
6.5 We may change prices for future periods. For running subscriptions and licences we will notify you of a price change by e-mail at least 30 days before it takes effect; the new price applies from the next billing period after the effective date. If you do not agree, you can cancel before the change takes effect.
7. Subscriptions: renewal, changes and cancellation
7.1 Subscriptions are concluded for an indefinite period with a monthly or yearly billing period. They renew automatically at the end of each billing period for the same period and are charged at the price then valid until you cancel them. The next renewal date and the price are always shown in the billing portal in the dashboard, where you can also cancel. Consumers resident in Germany may, after the first year, terminate at any time with one month's notice; consumers in France have the rights under Article L215-1 of the Code de la consommation.
7.2 You can cancel a subscription at any time in the Stripe customer portal (accessible from the Billing page of the dashboard). Cancellation takes effect at the end of the current paid billing period; until then you can continue to use the plan. Payments for a period already begun are not refunded, unless sections 18, 19 or mandatory law provide otherwise.
7.3 The quota is counted in a rolling period of 30 days that starts with the first proof created in the period. Unused proofs do not carry over to the next period.
7.4 You can change your plan in the Stripe customer portal. An upgrade takes effect immediately and the price difference is settled proportionally (proration) by Stripe; a downgrade takes effect as Stripe shows it in the portal. Additional seats are charged proportionally for the rest of the billing period at the time they are added; removed seats are credited against the next invoice.
7.5 When a subscription ends, the Account changes to the free Account. Existing proofs, evidence packages and public proof pages remain available; creating new proofs requires a new plan or credits.
8. Proof credits (packs)
8.1 One pack contains 3 proof credits for a one-time price. A pack is not a subscription and does not renew.
8.2 Proof credits do not expire while your Account exists. They are linked to your Account, are not transferable and cannot be exchanged for money.
8.3 If you move from credits to a subscription, your remaining credits are kept. They are used only once the subscription quota is exhausted, and clause 8.2 applies to them. If the subscription ends while credits remain, the Account returns to the credit plan.
8.4 Credits lapse when the Account is deleted. If the payment for a pack is fully refunded or reversed (chargeback), the credits from that pack are removed.
9. Assisted Capture
9.1 In Assisted Capture our operator captures, on your behalf, the URLs you submit, using the methods of the Service, and sends you the evidence: a link to the public proof page of each capture, the evidence package (ZIP and PDF report) and, for the Evidence Pack and Incident Pack tiers, a summary. No Account is needed. Direct links to publicly accessible files (for example a PDF) can also be submitted; one file counts as one URL.
9.2 The tiers are as follows (prices excl. VAT and incl. 21 % VAT):
| Tier | Price excl. VAT | Price incl. VAT (consumers) | URLs | Delivery time |
|---|---|---|---|---|
| Single | 49 € | 59.29 € | 1 | within 90 minutes |
| Evidence Pack | 149 € | 180.29 € | up to 5 | within 3 hours |
| Incident Pack | 349 € | 422.29 € | up to 15 | within 6 hours |
| Rush | 249 € | 301.29 € | up to 5 | within 60 minutes (guaranteed) |
| Crisis Response | from 699 € | from 845.79 € | by agreement | by agreement (individual quote) |
9.3 Delivery time. The delivery time runs from the successful completion of the payment and only within our operating hours, every day from 9:00 to 21:00 Central European Time (CET/CEST). For an order paid outside the operating hours, the delivery time starts at 9:00 on the next day. The delivery time is met when the evidence has been sent to the e-mail address you provided.
9.4 Rush guarantee. If we do not deliver a Rush order within 60 minutes (calculated under 9.3), we will refund 50 % of the price. The refund is processed within 24 hours after the deadline was missed, to the original payment method; you do not have to request it.
9.5 Capture not possible. If a URL cannot be captured (for example the content no longer exists, is geo-blocked or is technically inaccessible to us), we will inform you. If none of the submitted URLs can be captured, we will refund the full price. If only some URLs cannot be captured, we will refund the part of the price corresponding to those URLs (the price divided by the number of URLs submitted). Refunds are processed within 24 hours. If the evidence has a quality defect, we will capture the URL again free of charge, provided the content is still available. If a new capture is not possible, you are entitled to a reasonable price reduction or a refund for the URL concerned. Your rights for defective performance under section 19 are not affected.
9.6 Content behind a login. Where you ask us to capture content visible only to signed-in users, we may use our own accounts on the relevant platform; the evidence then shows the content as it was displayed to that account. We do not need your passwords. Capturing with your own access credentials is possible only by separate agreement.
9.7 We may refuse an order or a URL whose capture would breach section 11 or the law; in that case we refund the price for the refused part. Your notes are used only to carry out the order.
9.8 Unless you ask for private delivery in the order (for example in the notes field), we publish the proofs on a public proof page accessible to anyone who has the link (marked so that search engines do not index it). On request we will revoke a public proof page; the proof itself remains immutable (section 5.3).
10. Forensic Browser licence
10.1 The Forensic Browser is a desktop application for Microsoft Windows. It requires a computer with Microsoft Windows 10 or 11 (64-bit) and an internet connection for sealing; the licence is bound to devices (technical protection measure). Captures and sealed files are made and stored on your computer. For sealing, the application sends our stamp server the hash of the capture (never the captured content or the files themselves) together with the data needed to run the licence: the licence key, a device fingerprint, a device label (computer name, operating system and application version) and the licence holder name you set in the application. The stamp server obtains the qualified timestamp.
10.2 Licence. Upon payment we grant you a non-exclusive, non-transferable licence, limited to the term of the subscription, to install and use the Forensic Browser for your own purposes or the internal purposes of your organisation. The licence covers up to 3 devices; with the multi-device add-on up to 50 devices. Devices are bound to the licence on activation. The licence key is sent to you by e-mail after payment.
10.3 Stamp quota. Each licence tier includes a number of stamps for each licence year (counted from the start or anniversary of the licence), as stated in the price list at the time of the order. Unused stamps do not carry over. When the quota is used up, no further stamps are issued until the next licence year or a change of tier.
10.4 Term and renewal. The licence is sold as an annual subscription through Stripe and renews automatically for a further year at the price then valid, unless you cancel it. You can manage the subscription (change tier, add or remove the multi-device add-on, download invoices, cancel) via the management link at getproofanchor.com/forensic-manage. Cancellation takes effect at the end of the paid licence year; until then the licence remains fully functional. The next renewal date and the price are always shown on the management page, where you can also cancel. Consumers resident in Germany may, after the first year, terminate at any time with one month's notice; consumers in France have the rights under Article L215-1 of the Code de la consommation. Clause 6.5 applies to price changes.
10.5 Restrictions. You may not sell, rent, sublicense or otherwise make the licence or licence key available to third parties outside your organisation, circumvent the device binding, the quota or other technical protection measures, or modify, decompile or reverse engineer the application, except to the extent mandatory law permits this. Open-source components are subject to their own licences.
10.6 If a licence payment is refunded or successfully disputed, or if the licence is misused, we may deactivate the licence. Stamps already issued remain valid and verifiable.
11. Acceptable use and notices of illegal content
11.1 You may use the Service only lawfully and in accordance with these Terms. In particular, you must not:
- capture content without a lawful purpose, or in a way that unlawfully interferes with the rights of others (in particular privacy, personal data protection, copyright, trade secrets);
- use the Service to obtain, store or distribute content whose possession or distribution is unlawful, in particular child sexual abuse material, or for stalking, harassment, doxing or other targeting of individuals;
- attack, overload or test the security of the Service or of third-party systems through the Service, circumvent access controls or rate limits, or use the Service to access internal or non-public networks;
- capture content behind a login using credentials you are not authorised to use, or circumvent technical measures protecting content in breach of the law or of the platform's terms;
- misrepresent proofs or evidence packages, in particular by presenting altered files as original;
- resell the Service or use it to build a competing service without our written consent.
11.2 If we have reasonable grounds to believe that you are breaching section 11.1, we may refuse the capture, suspend the Account, revoke the publication of a proof page or terminate the contract under section 17. Where the law requires it, we will report unlawful content to the competent authorities.
11.3 Digital Services Act. Our single point of contact for Member State authorities, the Commission and the European Board for Digital Services, and for users, under Articles 11 and 12 of Regulation (EU) 2022/2065, is hello@getproofanchor.com; communication is possible in Czech and English.
11.4 Anyone can notify us of content they consider illegal (e.g. a public proof page) at hello@getproofanchor.com, stating the link, the reasons, their name and e-mail and a statement of good faith. We will process notices in a timely, diligent and objective manner, confirm receipt and inform the notifier of the outcome.
11.5 If we restrict content or an Account (e.g. unpublishing, suspension), we will give you a statement of reasons under Article 17 of the Regulation and inform you of the available redress, including a complaint to hello@getproofanchor.com and recourse to the courts. Decisions are taken by a human; automated tools are used only for technical security (e.g. blocking internal addresses).
12. Your content and data protection
12.1 You are responsible for the Content and for deciding what you capture, for what purpose and with whom you share it. You confirm that you have a lawful basis for capturing and further using the Content, including any personal data of third parties it contains.
12.2 For personal data in the Content you are the controller and we process it as your processor. For business customers, the Data Processing Agreement at getproofanchor.com/dpa applies and forms part of the contract; it is concluded by accepting these Terms and can be provided signed on request. For consumers capturing content solely for personal purposes, we act as controller for that data, as described in the Privacy Policy (section 2.2).
12.3 We process your own personal data as a controller in accordance with the Privacy Policy at getproofanchor.com/privacy.
12.4 You grant us the non-exclusive right to store, process, reproduce and display the Content to the extent necessary to provide the Service (including the public proof page if you publish it). We do not use the Content for any other purpose.
13. Evidential value and no legal advice
13.1 The Service creates tamper-evident records: any change to the sealed files of a proof (the captured files whose SHA-256 hashes are listed in the timestamped payload) after its creation can be detected through the qualified timestamp, the hash manifest and the OpenTimestamps anchor. The report, proof.json and manifest.json are generated when the package is downloaded and are not sealed; the sealed files are authoritative. Under Article 41(2) of the eIDAS Regulation, a qualified electronic time stamp enjoys the presumption of the accuracy of the date and time it indicates and of the integrity of the data to which that date and time are bound; under Article 41(3) it is recognised in all EU Member States.
13.2 This presumption does not cover the truthfulness, completeness or authorship of the captured content, nor the context in which it was displayed to other users. Websites may show different content to different visitors, locations or devices. The presumption relates to the time stated in the timestamp, not necessarily to the moment of capture: for browser-extension proofs this is the time our server received the capture, and for a timestamp obtained later (clause 5.2) the time it was issued. Extension proofs are created on your device and do not evidence independent observation of the content.
13.3 We do not guarantee that a proof will be admitted as evidence, or the outcome of any court, administrative, arbitration or other proceedings. The evidential value is assessed by the court or authority. We publish our capture methodology in the PDF report of each proof and in our documentation so that it can be examined.
13.4 We are not a law firm and do not provide legal advice. Information on our website and in our communication is of a general nature. Please consult a lawyer about your specific case.
14. Availability and changes to the Service
14.1 We take care to keep the Service available and secure, but for the free Account, packs and the standard subscriptions we do not guarantee any particular availability (no service level agreement). Availability or response times may be agreed in a Custom plan.
14.2 We may carry out maintenance and, where possible, schedule it so that it causes minimal disruption. The Service depends on third parties (in particular the qualified trust service provider, the Bitcoin network and OpenTimestamps calendars, Stripe and hosting); their outages may delay the completion of proofs.
14.3 We continuously develop the Service and may change its features for reasons of technical development, security, changes in the law or changes to our suppliers' services (e.g. the qualified trust service provider), provided that the essential features of a paid plan you have already paid for are not reduced during the paid period. A change must not cause additional costs to the consumer. If we change the Service to your detriment in a way that is not merely minor, we will inform consumers in advance on a durable medium; consumers may then terminate the contract free of charge within 30 days of the change or the notification, whichever is later, and receive a proportionate refund of the price paid for the remaining period.
15. Intellectual property
15.1 The Service, our software (including the Forensic Browser and the browser extension), the website, the reports and the GetProofAnchor brand are protected by intellectual property rights belonging to us or our licensors. Except for the rights expressly granted in these Terms, no rights are transferred to you.
15.2 The verification tool gpa-verify is open-source software and is subject to its own licence published in its repository.
15.3 Rights to the Content remain with you or with the relevant third parties. Third-party content contained in proofs may be used only to the extent permitted by law (for example for the exercise or defence of legal claims).
15.4 If you send us suggestions or feedback, we may use them freely without obligation to you.
16. Liability
16.1 Business customers. Our aggregate liability to a business customer for all damages arising out of or in connection with the contract from all events in a calendar year is limited to the fees paid by the customer for the Service in the 12 months before the first such event, and to at least EUR 500. We are not liable for indirect or consequential damage, lost profit, loss of business opportunity or reputation, or for the outcome of proceedings. Business customers are responsible for keeping their own copies of the evidence packages.
16.2 The limitations in 16.1 do not apply to damage caused intentionally or through gross negligence, to harm to the natural rights of a person (life, health, privacy) or to any other liability that cannot be limited by law.
16.3 Consumers. Consumers' statutory rights are not affected by these Terms. We are liable to consumers in accordance with the law; nothing in these Terms excludes or limits liability that cannot be excluded or limited in relation to consumers.
16.4 Neither party is liable for a failure to perform caused by an extraordinary, unforeseeable and insurmountable obstacle arising independently of its will (section 2913(2) of the Civil Code), for as long as it lasts. An outage of the qualified trust service provider or another of our suppliers excuses us only if it itself meets these conditions; the obligation to refund the price of performance not provided is unaffected.
16.5 Business customers are liable for damage caused to us or third parties by using the Service in breach of section 11 or the law, and will indemnify us against third-party claims arising from such use. Consumers are liable in accordance with the law.
17. Suspension and termination
17.1 You may end the contract at any time by cancelling your paid services (sections 7 and 10) and by deleting your Account in the dashboard. The deletion of the Account cannot be reversed. The owner of a team workspace with other members must first transfer ownership or remove the members.
17.2 We may terminate a contract for an indefinite period (including the free Account) by e-mail with a notice period of 30 days; for a paid subscription the termination takes effect at the earliest at the end of the paid period. We may terminate the contract with immediate effect or suspend access if you materially breach these Terms, in particular section 11, or if the law requires it; where appropriate we will first call on you to remedy the breach. If we terminate other than for your breach of these Terms, we will refund the price of unused credits and the proportionate part of any prepaid period.
17.3 What happens to your data. Before deleting the Account you can download your evidence packages and export your data in the dashboard. When the Account is deleted, your personal data is anonymised, the captured files (screenshots, page sources, network logs, videos and other artefacts) of proofs in your personal workspace are deleted, and those proofs are revoked and unpublished. The hashes, timestamps and entries in the append-only proof log are kept without the captured content and without any link to your Account, so that evidence packages you have already downloaded remain verifiable. An active subscription is cancelled. Proofs in a team workspace remain with the workspace. Details are given in the Privacy Policy.
18. Consumers: right of withdrawal
18.1 As a consumer you have the right to withdraw from a contract concluded at a distance within 14 days of its conclusion, without giving any reason. To exercise it, send us a clear statement (for example by e-mail to hello@getproofanchor.com) before the deadline expires; you can use the model form in the annex, but you do not have to. The deadline is met if you send the statement before it expires.
18.2 Request for immediate performance. Our services start immediately after payment. Before you pay, the checkout therefore asks you to tick a separate box, which is not pre-ticked and which is worded for the product concerned. By ticking it you request that performance starts before the withdrawal period expires and acknowledge the consequences set out in clause 18.3. Without it the order cannot be completed. We confirm the contract by e-mail, repeating the text of your request and acknowledgement, the date and time it was given and the version of these Terms with a link to it.
18.3 The consequences differ by product:
- Proof credits (pack) are a prepayment for a digital service. If you withdraw within 14 days, we refund the price of the unused credits; for each credit already used you pay its proportionate share of the price (pack price divided by the number of credits). If you have given the request and acknowledgement under 18.2, you lose the right of withdrawal once all credits of the pack have been used.
- The Forensic Browser licence comprises the application (digital content) and the qualified stamping service for the licence year (digital service). If you have given the request and acknowledgement under 18.2, you lose the right of withdrawal as regards the application once the licence key has been made available to you. For the stamping service you may withdraw within 14 days; we then refund the price less the proportionate amount for the time the licence was active. After withdrawal we deactivate the licence; stamps already issued remain valid.
- Assisted Capture is a service. If you have given the request and acknowledgement under 18.2, you lose the right of withdrawal once the service has been fully performed, i.e. when the evidence has been delivered. If you withdraw before that, you pay an amount proportionate to what has been provided up to the moment you informed us of the withdrawal.
- Subscriptions are a digital service provided continuously. You may withdraw within 14 days; if you requested that the service starts during the withdrawal period, you pay the proportion of the price corresponding to the period from the start of the service until the withdrawal.
18.4 If you withdraw, we will refund all payments received from you, less any proportionate amount under 18.3, without undue delay and at the latest within 14 days of receiving your withdrawal, using the same payment method you used, unless you expressly agree otherwise. You will not incur any fees for the refund.
18.5 Proofs created before the withdrawal remain immutable (section 5.3); after the withdrawal you may not continue to use the digital content or service.
18.6 Legal basis: in particular sections 1829 to 1837 of the Czech Civil Code (Act No. 89/2012 Coll.).
19. Complaints and rights from defective performance
19.1 We are responsible for ensuring that the Service and the digital content correspond to the contract and to the law at the time of delivery and, for continuous supply (subscriptions, licences), during the whole term. The rights from defective performance are governed by the Czech Civil Code, in particular sections 1914 to 1925 and, for consumers, sections 2389a et seq. on the supply of digital content and digital services.
19.2 How to complain. Send your complaint to hello@getproofanchor.com and describe the defect, the proof ID or order and, if possible, attach a screenshot or the evidence package. We will confirm receipt of the complaint without undue delay and issue you a written (e-mail) confirmation of when you made the complaint, its content and how it was resolved.
19.3 For consumers, we will decide on the complaint without undue delay, at the latest within 3 working days, and resolve it, including the remedy of the defect, without undue delay and at the latest within 30 days of its receipt, unless we agree a longer period with you.
19.4 If the digital content or service is defective, a consumer may demand that the defect be remedied free of charge (for example a new capture or a new delivery of the evidence). If remedying the defect is impossible, disproportionate, is refused, is not done within a reasonable time or without significant inconvenience, or if the defect is serious or recurs despite a remedy, the consumer may demand a reasonable price reduction or withdraw from the contract; withdrawal is not possible for a minor defect.
19.5 For one-off supply (credits, Assisted Capture), consumers may assert defects that become apparent within two years of delivery; for continuous supply, defects that become apparent during the term of supply. Refunds under the Assisted Capture rules (section 9) are in addition to these rights.
19.6 Business customers must report defects without undue delay after discovering them; section 16 applies.
19.7 For consumers resident in France, the legal guarantee of conformity for digital content and digital services under Articles L224-25-12 et seq. of the French Consumer Code also applies to the extent that it is mandatory.
20. Out-of-court resolution of consumer disputes
20.1 If a dispute with a consumer cannot be resolved directly with us, the consumer may submit a proposal for out-of-court resolution to the Czech Trade Inspection Authority (Česká obchodní inspekce, ČOI), Alternative Dispute Resolution Department, Štěpánská 15, 120 00 Praha 2, website www.coi.cz/en, online form at https://adr.coi.cz. The proposal can be submitted within one year of the day on which the consumer first exercised the right in dispute with us.
20.2 Consumers from other EU countries can also obtain help from the European Consumer Centre in their country (ECC-Net). Supervision of compliance with consumer protection law is carried out by the Czech Trade Inspection Authority; supervision of personal data protection by the Office for Personal Data Protection (www.uoou.gov.cz).
20.3 The right to bring the matter before a court is not affected.
21. Governing law and jurisdiction
21.1 The contract and these Terms are governed by Czech law, in particular the Civil Code (Act No. 89/2012 Coll.) and, for consumers, the Consumer Protection Act (Act No. 634/1992 Coll.). The UN Convention on Contracts for the International Sale of Goods does not apply.
21.2 If you are a consumer with habitual residence in another country, the choice of Czech law does not deprive you of the protection afforded by the mandatory provisions of the law of your country of residence.
21.3 Disputes with business customers are decided by the courts of the Czech Republic having local jurisdiction according to our registered office. Consumers may bring proceedings in the courts of the country where they are domiciled or in the Czech Republic; we may bring proceedings against a consumer only in the courts of the consumer's country of domicile.
22. Changes to the Terms
22.1 We may change these Terms for good reason, in particular because of changes in the law, in the Service, in our pricing model or for security reasons. For contracts for an indefinite period (Account, subscriptions, licences) we will inform you of the change by e-mail at least 30 days before it takes effect.
22.2 If you do not agree with the change, you may terminate the contract before the change takes effect; subscriptions and licences can be cancelled with effect at the end of the paid period, and if the change affects you adversely before then, you may terminate with effect from the date of the change and receive a proportionate refund. If you do not terminate, the changed Terms apply from the effective date.
22.3 Contracts for one-off performance (packs, Assisted Capture) are governed by the version of the Terms valid at the time of the order.
23. Final provisions
23.1 We communicate with you mainly by e-mail to the address associated with your Account or order. Notices to us must be sent to hello@getproofanchor.com.
23.2 If any provision of these Terms is or becomes invalid or ineffective, the other provisions are not affected; the invalid provision will be replaced by a provision that comes closest to its purpose.
23.3 We may assign the contract to a successor in the event of a transfer of our business, provided that your position does not deteriorate; we will inform you in advance. A business customer may assign the contract only with our consent.
23.4 We are not bound by any code of conduct within the meaning of section 1826(1)(e) of the Civil Code.
23.5 These Terms, version 2.0, take effect on 20 October 2026 and replace the previous version of 1 January 2026. Previous versions are available on request.
